This action follows his statement of extensive evidence of war crimes and crimes against humanity committed during the ongoing genocide in Palestine, underscoring what the ICC describes as their commitment to justice and accountability.

Prosecutor Khan’s applications specifically target Israeli Prime Minister Benjamin Netanyahu and Defense Minister Yoav Gallant. The charges against these Israeli officials include starvation of civilians as a method of warfare, willful killing, causing great suffering, persecution, and other inhumane acts as crimes against humanity. The ICC’s evidence suggests that Israel’s actions, including the imposition of a total siege on Gaza and the obstruction of essential supplies such as food, water, and medicine, have led to severe malnutrition, dehydration, and widespread suffering. These measures, according to the ICC, were not merely military tactics but deliberate acts of collective punishment aimed at the civilian population.

Khan announced he would prioritize cases referred by the UN Security Council (UNSC), a body where the U.S. wields significant influence through its veto power. This approach effectively sidelined the Palestine case, which has not been referred by the UNSC due to U.S. opposition. Despite this, Khan quickly moved to prosecute Russian President Vladimir Putin, raising questions about his consistency and impartiality in the pursuit of justice.

His decision to drop the Afghanistan genocide investigation, allegedly at the behest of the U.S., has further fuelled these concerns.

During his campaign for ICC prosecutor, Khan emphasized his heritage and personal connections, such as his relationship with his “adopted grandfather,” Muhammad Zafarullah Khan, a prominent Pakistani diplomat who opposed the creation of Israel. Despite these assurances, his actions in office have often seemed to favor the geopolitical interests of the U.S. and Israel over an unbiased pursuit of justice.

The issuance of arrest warrants against prominent figures from both Israel and Hamas is likely to have significant political ramifications. These actions will likely affect diplomatic relations between ICC member states, the Israeli regime, and Palestine. The potential impacts on peace negotiations and the broader conflict dynamics are considerable, with this move potentially catalyzing new efforts toward peace or exacerbating existing tensions.
