He was gearing up for a North American speaking tour focused on urging the U.S. to redirect foreign aid from Israel toward domestic priorities, while sharply criticising Israel’s “genocidal war crimes” in Gaza. But instead of hitting the stage, he was swiftly detained by Immigration and Customs Enforcement (ICE), his visa revoked on murky “national security” grounds that critics argue were a thin veil for punishing his outspoken views.

Held at the Mesa Verde ICE Processing Center in Bakersfield, California, Hamdi endured harsh conditions, including a health scare involving severe rib pain that initially went untreated until legal intervention kicked in. His case exploded online, drawing fire from far-right figures like Laura Loomer, who bragged about influencing officials to target him, while supporters including UK MPs, media outlets, and rights groups demanded his immediate release.

DHS’s Hypocrisy, Inflammatory Claims and the Manufactured Charges

The Department of Homeland Security (DHS) fuelled the controversy with a pointed statement on X, accusing Hamdi of supporting terrorism. In an October 27 post, DHS claimed Hamdi “cheered on” the October 7, 2023, attacks, quoting him as saying, “How many of you felt it in your hearts when you got the news that it happened?” They stated, “The U.S. has no obligation to host foreigners, like Sami Hamdi, who support terrorism and actively undermine the safety of Americans. And we won’t,” crediting officials like Secretary Noem and Rubio for revoking his visa and placing him in ICE custody. A follow-up post on November 5 reiterated this stance, emphasising no room for “terrorist sympathizers” and warning against hiding behind the First Amendment to advocate for “anti-American and anti-Semitic violence.” The problem with these baseless claims by the DHS is the lack of evidence and inconsistency in stance.

The DHS tweet featured a video clip sourced from MEMRI TV, a pro-Israel media monitoring organization often criticized for selectively editing content to portray Muslim voices negatively. Despite these grave allegations of terrorism support and national security threats, the U.S. government ultimately COULDN’T charge Hamdi with a single criminal activity. The only formal issue raised was a “visa overstay”, a charge manufactured after DHS secretly revoked his valid visa upon arrival, without providing any prior notice or concrete evidence of wrongdoing. Critics, including rights groups, argue this revocation lacked a plausible reason beyond punishing his criticism of Israel’s genocidal policies in Gaza.

The posts drew sharp backlash in the comments, with many users mocking DHS as the “Department of Israel’s Security” or “Homeland Department of Israel” instead of the U.S., highlighting perceived bias. This sentiment underscores a deeper hypocrisy: If DHS were truly concerned about terrorism, why extend VIP treatment to Israeli Prime Minister Benjamin Netanyahu during his multiple White House visits in 2025? Netanyahu faces active arrest warrants from the International Criminal Court (ICC) for war crimes and crimes against humanity related to Gaza, and Turkey recently issued its own warrant accusing him of genocide. Yet, he has been welcomed with open arms by U.S. leaders, raising questions about selective enforcement. This episode underscores how the U.S. appears complicit in silencing free speech and journalistic voices advocating for Gaza, using immigration tools as a weapon to stifle dissent rather than addressing substantive threats.

The Legal Turning Point

The turning point came during Monday’s immigration hearing, where the U.S. government backed down amid a brewing First Amendment lawsuit filed by the Council on American-Islamic Relations (CAIR)-California, attorney Hassan Ahmad of HMA Law Firm, and the Muslim Legal Fund of America (MLFA). The feds dropped any pretense of serious charges, admitting the only issue was a “visa overstay”, one they engineered by secretly canceling his entry permit after he arrived. With no evidence of criminal activity or security threats, Hamdi opted for voluntary departure to reunite with his wife, Soumaya, and kids back home.

Family and Advocacy Reactions

His father, Dr. Mohamed Elhachmi Hamdi, echoed the joy in a heartfelt statement: “All praise and thanks be to God Almighty… This decision brings joy to me, his mother, his wife, our entire family, and all of Sami’s supporters around the world.” But he didn’t mince words on the fallout, calling out the “bitterness and shock” from the U.S. government’s handling and urging an apology: “Journalism is not a crime. Free opinion is not a crime.”

CAIR-CA CEO Hussam Ayloush hailed the outcome as a step forward but pulled no punches on its implications. “Sami never should have spent a single night in an ICE cell. His only real ‘offense’ was speaking clearly about Israel’s genocidal war crimes against Palestinians,” Ayloush said. “This sends a chilling message to every activist and journalist and every authoritarian dictatorship worldwide who can now claim they are following America’s example.”
